Effective Date: January 1, 2025
By submitting the “Become a Brand Partner” application form, you (“Brand Partner,” “you,” or “your”)
agree to the following Terms and Conditions established by ChillBar Delivery (“we,” “us,” or “our”),
based in Alberta, Canada.
- Eligibility
- To apply as a Brand Partner, your business must:
- Be legally registered in Canada.
- Possess all required licenses and permits for the sale, promotion, or
distribution of your products.
- You must provide accurate and complete information during the application process,
including details about your business, products, and contact information.
- Submission Review and Approval
- Submission of the application form does not guarantee approval as a Brand Partner.
- ChillBar Delivery reserves the right to approve or reject any application at its sole
discretion based on alignment with our business values, product fit, and operational
capacity.
- Brand Partner Responsibilities
- Compliance:
- You are responsible for ensuring that your products comply with all applicable
federal, provincial, and municipal laws, including those related to labeling,
advertising, and the sale of alcohol.
- Product Information:
- You must provide accurate product details, including descriptions, pricing,
promotional materials, and any required certifications.
- Promotional Activities:
- Any collaborative promotional activities must be pre-approved by ChillBar
Delivery and comply with applicable advertising laws, including restrictions on
alcohol advertising.
- Intellectual Property
- By partnering with ChillBar Delivery, you grant us a non-exclusive, royalty-free license
to use your brand name, logo, and promotional materials for the purpose of marketing and
selling your products.
- You warrant that you own or have the necessary rights to use all intellectual property
provided to ChillBar Delivery.
- Financial Terms
- Financial terms, including commission rates or promotional fees, will be negotiated upon
approval of your application.
- You are responsible for any applicable taxes on transactions resulting from this
partnership.
- Termination
- Either party may terminate the partnership by providing 30 days’ written notice.
- ChillBar Delivery reserves the right to terminate the partnership immediately in the
event of a breach of these Terms or applicable laws.
- Confidentiality
- Both parties agree to keep confidential all proprietary or sensitive information
disclosed during the partnership, except where disclosure is required by law.
- Privacy and Data Protection
- ChillBar Delivery will handle all personal and business data provided during the
application process in compliance with the Personal Information Protection Act (PIPA) of
Alberta.
- You agree not to access or misuse any customer data shared during the partnership.
- Amendments
- ChillBar Delivery reserves the right to modify these Terms and Conditions at any time.
Updates will be communicated via email or posted on our website. Continued participation
in the program constitutes acceptance of the updated Terms.
- Governing Law
- These Terms and Conditions are governed by the laws of Alberta, Canada. Any disputes
will be resolved under Alberta law.
